1. Acceptance of Terms
By accessing or using Capsulate ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.
2. Description of Service
Capsulate is an email intelligence platform that uses artificial intelligence to analyze, extract, and organize data from your email accounts into customizable dashboards.
The Service includes but is not limited to:
- Email data extraction and analysis
- AI-powered insights and summaries
- Automated dashboard generation
- Data visualization and reporting
- Integration with email service providers
2.1 Applications Covered
These Terms apply to Capsulate’s desktop, web, and mobile apps and its assistant connections. Connected assistants can access the Capsulate data and operations you authorize; their providers’ terms also apply to your use of those assistants.
2.2 Desktop App License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Capsulate macOS application solely for your internal business or personal use. You may not copy, modify, distribute, sell, lease, reverse engineer, or otherwise exploit the application except as expressly permitted by law.
2.3 Web App Access
We grant you a limited, revocable right to access and use the Capsulate web app through supported browsers, subject to these Terms and all applicable security and acceptable-use requirements.
3. User Accounts
3.1 Account Creation
To use the Service, you must create an account by connecting your email account through OAuth authentication. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Be responsible for all activities under your account
3.2 Account Eligibility
You must be at least 18 years old to use the Service. By creating an account, you represent that you meet this requirement.
4. Email Access and Data Processing
4.1 Email Authorization
By connecting your email account, you authorize Capsulate to:
- Access your basic Google account profile information for sign-in
- Read and analyze your email messages when you choose a Gmail-connected mode
- Extract data points as configured in your dashboards
- Generate AI-powered summaries and insights
- Update Gmail message state such as labels or read/archive status when you choose Full Gmail Access
- Store processed data in our secure cloud infrastructure
Access scopes are requested according to the mode you select during onboarding. Forwarding Only requests Google sign-in/profile scopes without Gmail access. Full Gmail Access requests `gmail.modify` to read messages and support mailbox actions.
4.2 Data Usage
We process your email data solely to provide the Service. We do not:
- Sell your data to third parties
- Use your data for advertising purposes
- Share your data except as outlined in our Privacy Policy
- Use Google user data to create, train, or improve generalized, foundational, or frontier AI or machine learning models
4.3 Revocation
You may revoke email access at any time through your account settings or by disconnecting Capsulate from your email provider's security settings.
4.4 Google API Services Compliance
Capsulate's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. We do not sell Gmail data, we do not use Gmail data for ads, and we only share Gmail data as necessary to provide the Service.
For clarity, the Google scopes we currently request are limited to basic profile scopes for sign-in and `gmail.modify` when you choose Full Gmail Access.
We do not use Google user data to create, train, or improve generalized, foundational, or frontier AI or machine learning models. Any processing of Google user data is limited to providing the user-facing features you request in Capsulate.
Your use of Google-connected features is also subject to Google's applicable terms and policies, including the Google APIs Terms of Service and Google API Services User Data Policy. Our Privacy Policy explains the specific Google user data Capsulate accesses, how we use it, how it may be shared with service providers, how it is protected, and how you can revoke access or request deletion.
4.5 No Training on Your Data
We do not train AI models on your personal email content or other Google user data. Any AI processing of your emails is performed only to provide features like extraction, search, and dashboards for your account.
5. Acceptable Use
You agree not to:
- Violate any applicable laws or regulations
- Infringe upon the rights of others
- Attempt to gain unauthorized access to the Service
- Reverse engineer or decompile the Service
- Use the Service to send spam or malicious content
- Interfere with the proper functioning of the Service
- Use automated means to access the Service without permission
6. AI-Powered Features
6.1 AI Tools and Analysis
Capsulate uses artificial intelligence and large language models (LLMs) to provide features including:
- Email summarization and categorization
- Semantic search and intelligent filtering
- Data extraction and pattern recognition
- Automated dashboard generation
- Predictive insights and recommendations
6.2 AI Output Limitations
You acknowledge and agree that:
- AI-generated content may not always be accurate or complete
- AI outputs should be reviewed before making important decisions
- Similar AI outputs may be generated for different users with similar inputs
- We do not guarantee the uniqueness of AI-generated content
6.3 Responsible AI Use
You agree not to:
- Misrepresent AI-generated content as human-created
- Use AI features to generate harmful, misleading, or illegal content
- Attempt to reverse engineer or extract AI models
- Use AI outputs to train competing AI systems
7. Subscription and Payment
7.1 Subscription Plans
Capsulate offers various subscription plans with different features and pricing. Current plans and pricing are available on our website.
7.2 Free Trial
We may offer a free trial period. At the end of the trial, you will be charged for the selected plan unless you cancel before the trial ends.
7.3 Billing
Subscriptions are billed in advance on a recurring basis (monthly or annually). You authorize us to charge your payment method on file.
7.4 Cancellation
You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. No refunds are provided for partial periods.
8. Intellectual Property
8.1 Ownership
The Service, including all software, designs, text, graphics, and other content, is owned by Capsulate and protected by copyright, trademark, and other intellectual property laws.
8.2 Your Data
You retain all rights to your email data and content. By using the Service, you grant us a limited license to process your data as necessary to provide the Service.
9. Privacy and Security
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your data. By using the Service, you agree to our Privacy Policy.
We implement industry-standard security measures including:
- Encryption in transit (TLS/HTTPS)
- Encryption at rest (AES-256)
- Secure OAuth authentication
- Regular security audits
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
We do not warrant that:
- The Service will be uninterrupted or error-free
- Defects will be corrected
- The Service is free from viruses or harmful components
- Results from using the Service will be accurate or reliable
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPSULATE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold Capsulate harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
13. Termination
We may suspend or terminate your access to the Service:
- For violation of these Terms
- For non-payment of fees
- For suspected fraudulent or illegal activity
- At our discretion with or without notice
Upon termination, your right to use the Service ceases immediately. You may export your data within 30 days of termination.
14. Dispute Resolution and Arbitration
14.1 Informal Resolution
Before filing a claim, you agree to try to resolve the dispute informally by contacting us at legal@capsulate.app. We will attempt to resolve the dispute informally within 60 days.
14.2 Binding Arbitration
If we cannot resolve the dispute informally, any dispute arising from these Terms or the Service will be resolved through binding arbitration, except that either party may bring a claim in small claims court.
Arbitration will be conducted by a neutral arbitrator in accordance with the American Arbitration Association (AAA) rules. The arbitration will take place in California, or another mutually agreed location.
14.3 Class Action Waiver
YOU AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
15. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of California.
16. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.
